    The DUI Process

    The DUI process begins when you are pulled over on suspicion of DUI. Police will administer field sobriety tests, and then the breathalyzer test. If it is above the legal limit (0.08), you will be charged with DUI. You will usually be able to bond out and be released from custody within a few hours.

    Depending on your charge, you will either receive a notification to come to the courthouse to set a court date (DUI 1st) or you will be given an order to appear at an arraignment within a few days (DUI Excessive and DUI 2nd). If you are ordered to appear at an arraignment, you will be informed of the charges against you and asked to enter a plea. You should have an attorney at this hearing. There is a high chance that you will be placed on Pretrial Supervision, and an attorney can argue to the judge on your behalf, and ensure that you are fully informed of the steps you’ll need to take after the hearing.

    In about a month, you will have a pretrial conference. If you are contesting the charges, the judge may rule on some of the legal issues. Here, you may negotiate a plea bargain if that is what is best in your case. If you have not reached a plea agreement, the judge will schedule a new pretrial conference. If you want to fight the charges, the judge will set a hearing date for a criminal trial.

    DUI Charges In Idaho

    The Idaho Criminal Code charges a person for drinking in public places with a blood alcohol content of less than 0.08 percent with the following stipulations. Idaho has a zero-tolerance policy for driving under 21.

    • There can be a jail sentence of up to six months.
    • If the motorist has a blood alcohol level over .20, they will see prison time between 10 days and one year.
    • In addition, there will be a license suspension between 90 and 180 days.

    The penalties rise on subsequent convictions.

    • The second offense carries a jail sentence between ten days and one year, while the third offense has a minimum sentence of 30 days with jail time of up to a year.

    A lot of advice you see on the internet tells you not to consent to a breathalyzer test if you are under suspicion of DUI. This is not always the best decision. If you refuse the breathalyzer test, a civil refusal case will be brought against you, and your license could be suspended for 1 year, regardless of if you are guilty of DUI or not.

    Even if you refuse the breathalyzer test, the officer will still be able to request a warrant from the judge to draw your blood, and if signed, they will still be able to obtain evidence that could incriminate you of a DUI. This leaves you with a DUI charge as well as a 1-year license suspension. If you are charged with a refusal, contact a lawyer immediately. You have 7 days from the date of your arrest to appeal the 1 year license suspension penalty.
