Second Offense DUI

Second Offense DUI Lawyer in Boise

Facing Charges? Call Us Today

The penalties for DUI in Idaho escalate for subsequent offenses. If you are charged with a second DUI offense within 10 years of your previous DUI, this means that you will be facing harsher penalties than you faced on your first offense. This unfortunately means that there could be some jail time on the table, and your license suspension will be much harsher.

Considering the harsher penalties, it’s in your best interest to hire an attorney. Our attorneys will help you set up a DUI evaluation, alcohol classes, and a Victim’s Panel, and they will help you complete anything else that we believe would be beneficial to your case.

Alternatively, if there are legal defenses in your case, our attorneys will fight for a fair outcome in your case and take your case to trial with no additional costs.

Penalties For 2nd Offense DUI In Idaho

Almost every penalty for 2nd Offense DUI is effectively doubled compared to 1st Offense DUIs.

If your first DUI was over the excessive BAC limit of 0.20, and your BAC for this offense is also over the excessive BAC limit of 0.20, you will face a felony DUI charge and the jail sentence will be between 30 days and five years. In addition, you can be fined up to $5,000 along with other penalties. Felony DUIs heavily depend on the facts of your situation, and it is best to speak with one of our attorneys about what penalties you could be facing.

In addition, the license suspension is also longer for a second offense, costing you driving privileges for at least one year. Finally, you will also need to pay a $1,000 fine.

Will I Lose My License?

The short answer to this is yes, and it will be for a long time. Idaho law requires an absolute driver’s license suspension of one year for a second offense.

Unlike a first offense, where you can apply for limited driving privileges, this option does not typically exist for a second offense**. This is why a second conviction will have an ever far greater impact than the first. When you do regain your license, you may still have restrictions with far higher auto insurance rates.

**If you are a resident of Canyon County and your DUI occurred in Canyon County, you may have the option of applying for DUI Court which could allow you to apply for a restricted license. For more information, contact our office and talk to one of our attorneys.

Will I Have A Permanent Criminal Record?

Unless you are found not guilty of this charge, it will be on your record permanently.

If you are convicted, this will stay on your record permanently unless your conviction is somehow overturned.

A DUI could impact your eligibility for certain jobs, especially those that require driving as part of the job. You may also have trouble with things like security clearances and professional licenses.
