Penalties for a Second Offense DUI in Idaho

If your prior DUI involved a BAC of 0.20 or higher and your current offense also involves a BAC of 0.20 or higher, and that prior offense occurred within the past five years, the charge escalates to a felony under Idaho Code section 18-8004c. A felony DUI charge carries 30 days to five years in prison and fines up to $5,000. Will I Lose My License?
Yes, and the suspension is more severe than on a first offense. Idaho law imposes a one-year absolute suspension of driving privileges for a second DUI conviction.

Once the suspension ends, you’ll be required to have an ignition interlock device installed on all vehicles you operate for an additional year before full reinstatement.
