Boise First Offense DUI Lawyer

Idaho has some of the harshest penalties for DUI’s. Although we cannot promise an outcome, with our knowledge and experience, we can give you an idea of what to expect.

All of the following are general estimates based on a standard DUI first offense sentence. If you were in a car accident, were non-compliant with law enforcement, had a high BAC, have prior misdemeanor convictions, etc., this could affect the outcome on your case.

If you are convicted of DUI first offense, you will likely be fined between $500-$750 plus court costs (~$200). If you bonded out of jail yourself and did not go through a bail bondsman, your $500 bond will be deducted from these fines. You will also be given the option to pay your fines on a payment plan for up to 11 months.

Most convicted of first offense DUIs do not go to jail. Likely you will be sentenced to approximately 5 days (40 hours) of community service minus any credit for time served when you were arrested. Keep in mind that this does heavily depend on the facts of your case (any potential aggravating factors such as a vehicle accident) as well as any criminal history.

Your license will be suspended for 6 months, however you will be able to apply for a restricted license after just 30 days to allow you to drive to work, school, or anywhere that is necessary.

You will be required to install an interlock device in your car for one year. If you have no prior criminal history, it is possible that you could ask for early relief of this requirement. Contact our office and we will discuss your options with you.

You will be placed on a period of unsupervised probation, most likely for one year. You will not have a probation officer, you will not be required to perform random drug or alcohol testing, and you will not have any travel restrictions. All that is required is that you complete all of your sentencing terms, and that you do not commit any new misdemeanors or felonies.

How Many Hours Of Community Service Will You Do If Convicted of a DUI (First Offense)?

For a first DUI offense, there is mandatory community service of at least 50 hours. This is just the minimum. You could be sentenced to more than that based on the severity of the offense and the particular judge.

What Happens For Your First DUI Offense?

This all depends on the circumstances of your conviction and the prosecutor. The law allows you to be sentenced to a prison term, even for a first offense.
